GOODS AND SERVICES
Preamble
1. These general conditions of sale apply to all Naturata products.
Article 1 - Object
1. The purpose of these general sales conditions is to provide and define all the necessary information to the user on the order, sale, payment and provision of services or delivery of purchases made on the website www.naturata.pt
2. These conditions regulate all the steps necessary to place the order and guarantee the follow-up of this order/service provision between the Contracting Parties.
Article 2 - Order
1. he User places his order by completing the purchase process presented on the website www.naturata.pt, adding the product(s) or service(s) he wishes to order to the shopping basket.
2. To send the order, the user must:
a. Register on the website www.naturata.pt, providing the information requested there.
b. Log in (providing a combination of email and password chosen by the uer when registering).
c. Complete the information and choose the options that are available to you throughout the order completion process (delivery and billing address, shipping method, payment method, as well as the TIN and the name that, for tax purposes, you want to appear on the invoice).
3. The final order confirmation is equivalent to full and complete acceptance of the prices and description of the products/services available for sale as well as these General Conditions of Sale which will be the only ones applicable to the contract thus concluded.
4. Naturata will honor orders received online up to the limit of available stocks. In the absence of product/service availability, Naturata undertakes to inform the user as soon as possible./p>
5. The data contained in the invoice are the sole responsibility of the user. The invoice once issued cannot be reissued with changes.
6. Order requests are valid for 3 days, unless the order is registered under a promotional campaign that defines a different term, it is not possible to guarantee the provision of the service, prices, discounts, promotions and offers beyond this term. If payment is not received by our services within that period, the order cannot be validated. Any amount received after this date will be returned or used for a new order.
Article 3 - Payment
1. On the website www.naturata.pt, Naturata proposes to the User the following payment methods via Easypay - Instução de Relógio Lda:
a. Credit card (Visa, Mastercard);
b. ATM reference;
c. Transfer;
d. Paypal.
2. In the case of payment by credit card, the debit will be made on the user's card immediately after confirmation of the shipment of the goods. If some products ordered are sold out, the value of them will be credited to the user's card, after the order is closed.
Article 4 – Delivery / Availability and Consumption
1. Delivery of orders takes place up to 20 working days after ordering, according to the standard and the shipping area. Delivery in Portugal is carried out by the company CTT Correios de Portugal, S.A. and outside Portugal by UPS.
2. Shipping costs will be added to the order.
3. The service will be made available after confirmation of the payment.
Article 5 – Price
1. Prices must be understood in Euros, with taxes and fees included, taking into account the VAT in force at the time of payment of the order.
2. If there is an increase in the prices of any product / service, the User will be informed immediately, being able to choose to receive his order (by paying the difference) or to proceed with its cancellation.
Article 6 – Cancellation and Return
1. The cancellation or return process is handled on a case-by-case basis by Naturata. The request must arrive in writing to the contact email contact@naturata.pt, up to 20 days after the order, and the instructions for cancellation or return of the amount paid and / or return of the goods, answered and defined by Naturata, by the same means of communication.
2. Whenever possible, the return must be made using the same payment method, but if this is not possible, the user must present proof of payment and account or card ownership, in order to make the return by Bank Transfer.
3. Please note that the costs associated with the return, namely the shipping costs, are the customer's full responsibility.
4. Naturata undertakes to refund the User within a maximum period of 10 days.
5. Returned products must be in sales condition, that is, in the same condition in which they arrived in the User's hands, without any anomaly or damage.
Article 7 – Right of free withdrawal
The consumers have the right to the free resolution of contract within 14 calendar days, without needing to give any reason to do so.
The deadline for using this right expires after 14 days from the day on which the consumer or a third party other than the carrier and indicated by the consumer acquires the material possession of each goods ordered.
In order to exercise this right, the consumer’s must communicate the decision of withdrawal of the present contract by sendig a forthright declaration to NATURATA. The consumer may do so by sending an e-mail to contact@naturata.pt or by using the standard withdrawal form, but without any obligation to do so.
To ensure that the deadline is met, it’s sufficient that the communication concerning the exercise of the right of withdrawal is sent by the consumer before the end of said deadline.
Article 8 – Effects of the right of withdrawal
If the present contract is terminated, the consumer shall be reimbursed with all the payments done, delivery costs included (except supplementary costs regarding a specific delivery choice different from the standard and free of costs option provided by us), without undue delay and, in every event, no later than 14 days counting from the date we’ve been informed about the consumers decision of the withdrawing the present contract. We’ll proceed with the reimbursement via the same payment method used by the consumer when the purchase was made, unless explicitly requested otherwise, either way, the consumer won’t incur in any expenses as a result of such reimbursement.
Naturata can withhold the reimbursement until we received the collected goods back, or until the consumer has supplied evidence of having sent back the goods, whichever is the earliest.
The consumer must return the goods or deliver them to us to Rua Padre António Vieira Nº 6 e 8, Parque Industrial Manuel da Mota 3100-354 Pombal, Portugal, without undue delay and, in every event, no later than 14 days counting from the date we’ve been informed about the consumer’s decision of the withdrawing the present contract. The deadline shall be deemed to have been observed if the goods are returned within the 14 days deadline. The consumer will have to bear the direct costs of the return.
The consumer shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to ascertain the nature and functioning of the goods.
Article 7 – Privacy Policy
1. The processing of your data is done in compliance with the legislation on the protection of personal data. These, subject to computer processing and encryption, will be included in Naturata's database(s) and are intended for the registration and presentation of other products and services, as well as institutional information, to be made available by them.
2. Its provision is optional and the right of access, rectification and cancellation of any data that directly concerns you, personally or in writing, directly to the address on the home page of this website is guaranteed, under the terms of the law.
